Pub’s smoking shelter must be demolished

A PUB has been ordered to pull down a smoking shelter "as big as a bandstand" after it was built without permission.

The 28ft by 16ft wood and plastic structure was put up at the Knuzden Brook Inn four months ago and Hyndburn Council has now rejected a retrospective planning application.

But landlord Brian Smith, who has run the pub since June, said he would appeal against the decision and claimed that the shelter was pivotal to his plans in the post-smoking-ban era.

Planning bosses turned it down because the L-shaped shelter at the back of the pub spoilt the look of the area and affects neighbouring properties with noise and disturbance.

And Coun Marlene Haworth, who represents the area and spoke against the application, said: "I appreciate that pubs need a smoking shelter and I'm not against them, but not one as big as a bandstand.

"It's an eyesore and the smell for neighbours must be atrocious.

"I had several residents call me up to complain about it and I'm not surprised.

"I don't know why the landlord didn't come to the council first and talk to our officers, all this could have been avoided."

Mr Smith hit back at Coun Haworth and said nobody had approached him to voice their concerns about the shelter.

He said: "I don't know who is objecting but they have not come to me.

"We have more children and families coming in here now it is a smoke-free zone and this was for them.

"I was going to put benches and tables underneath it so people could sit out here.

"It's such a sun trap during the summer and this would have added something extra. I will appeal against it because I have other landscaping plans for the back of the pub to fit in around the shelter."

Mr Smith added that he was intending to plant trees at the back to shield the pub from residents in Knuzden.

He said that he was not aware that the shelter, which cost around £2,000 to build, needed planning permission.

A neighbour said that it would be better if the smoking shelter was made smaller, but the pub was still "a nightmare" to live next to.

The resident, who did not want to be named, said his family were planning to sell their house to get away from the pub.

He said: "This smoking shelter is a complete eyesore, all the residents in the terrace row have to put up with smoke drifting into their back yards - and kitchens and living rooms if we have a window open - every night, and cigarette butts thrown over our fences."

tough s**t really, government shouldn't have introduced the smoking ban then and we would be free to smoke anywhere. I am glad its seen as an eyesore and i hope they get permission to leave it up. Bl**dy moaning non-smokers!!

Quite right too. Nasty, smelly habit. I don't think smokers realise the disgust with which most non-smokers - the majority of the population, other than among the poor, white working-class - view their drug of choice.

Bill,so what you are trying to insinuate in your most eloquent description is that the only smokers in this country are poor,white and working-class?!

the pub should get a petition going to save the smoking shelter. we will be down in blackburn on monday. and i will be in the smoking shelter

Let's get a petition up for the prime minister to save our smoking shelter seeing it was one of his big ideas !

Hopefully the next Tory government will over-rule this silly blanket ban and smokers free to kill themselves indoors once more rather than blocking the entrances to pubs as they do now !

I congratulate the landlord for providing a shelter for his customers, Butr i mut point out that all pubs do not have the space for a shelter. Our landlord allowed us to use his own private yard but the council came along on the pretence that someone had complained. Now it,s all back to sqaure one ,paperwork, planning ,red tape etc. In the meantime our oldeset customer who is a spritely 88 year old and has smoked all her life and has NEVER had any complaint,s from non-smokers has to brave the elements like the rest of us or stay at home and become a prisoner in her own home. May i add that this ladies husband and father both fought for this country in the last war, and I think any government, or local government officials should HANG THEIR HEADS IN SHAME for putting this lady in this position. There are many thousands of her age who are going throu the same banished to their homes (THINK ABOUT IT) I respect these elderly citezens for their sacrifise to this countrey and we should all look ater and protect them at all costs

What on earth are you talking about, I consider myself to be white working class, ie, I am white, I work and earn in excess of 40k per annum and yes I do smoke, I also have private medical insurance - get real!

Simple solution - don't buy a house next to a pub! If I buy a house next to Ewood Park, are they going to tell the supporters to keep the noise down because I complain or if I buy a house next to a railway line, will British Rail tell the drivers to cut the power and just coast past my garden. Get real and stop complaining, there's worse things going on out there! This landlord's just trying to keep his customers happy and his business afloat in troubled times for the licensed trade. Labour will be putting up drinks taxes again in the next budget, so there will be even less customers anyway.

Bill from Burnley - smoking isn't the preserve of the working classes - I know plenty of professionals that smoke, why do you think Marlboro Lights are so popular.

I think that it would be better to offer all NON-smokers the opportunity to use the smoking shelters for themselves...instead of pushing smokers outside to have a ciggy. No smoke contaminating others gardens or houses with windows open. YES..put the smokers INSIDE THE PUB and NON smokers in the shelters..Sorted!!!
It will never happen though will it?

Bill, While I think your comments at the end of your post are out of order I do agree with the first part in that it is disgusting for those who don't smoke, however, it's not that smokers don't realise it, it's that they don't care. I of course do care (I'm a non-smoker) about the fact that everytime someone goes into hospital with a smoking related illness that I, out of my National Insurance, have to pay for them to be seen to rather than my money being spent on care for people who are ill when they don't bring it on themselves. And yes, that goes for those people who drink to excess as well....

Sorry, Steve from Oswaldtwistle, you'll actually find it's the other way around. The smokers are paying for YOU if you get treated by the NHS. £10billion a year is raised from taxes on tobacco, but the NHS allegedly spends £2billion on smokers. Those maths suggest an £8billion profit to the NHS/ New Labour from people smoking!

Hyndburn council bosses should be ashamed of themselves and the petty way in which they are handling this case, if they had bothered to inspect the area properly they will see a nicely decked area well built and certainly not an eyesore.It is a vast improvement from how the garden was before. I can see no problem with the smoking area, if it was called a decked area for familys to sit from the sun or rain would this cause the same problems? I think not, but this is what it is a decked area no slate or tiled roof no doors so what is the problem.
my father ran the knuzden brook pub for 28 years and he would be up in arms over the jobsworths at Hyndburn council if he was still alive today. The pub was built well over 100 years ago long before Shadsworth or Knuzden estate was built and the people who buy property next to a pub should know what to expect! Give the landlord a break he is trying to make the pub work as a buisness the garden area is a vast improvement from before Mr. smith took over.
I would like to add I am not a regular at the pub although I live a few doors away, so this is not a customer siding with the landlord. COME TO YOUR SENSES HYNDBURN COUNCIL CLASS IT FOR WHAT IT IS A NICE PIECE OF GARDEN FURNITURE NOT JUST A SO CALLED SMOKING AREA.

Sandra, unfortunately the local authorities led by New Labour have declared war on smokers and drinkers, so licensees are unfortunately top of their hit list.

After "denormalising" smoking as it was described, they have moved onto alcohol now, basically classing everyone who drinks as binge drinkers.

For the last couple of weeks, the newspapers have contained many articles about the authorities restricting drinking, even reverting back to the old licensing hours.

There's no middle ground with New Labour and the Councils, you are either a non-smoker or a chain smoker, a tee-totaller or a binge drinker.

I wish the Landlord of this pub every luck, because the authorities would prefer us sat at home drinking cocoa with our ID cards hung around our necks!

we had a pub until jan 07 a good business to,but we knew when the smoking ban came, the trade would go. we had 20 years in the pub trade and now most pubs are struggling. bloody smoking ban

Nanny State 2, I suspect that the revenue from Tobacco sales is probably supporting the war in Iraq rather the NHS. You'll be telling me next that the money raised from fueld duty and road tax goes to improving the roads !
